South Carolina is the center of a judicial struggle to allow legalized video poker, a variation of poker that is enjoyed in many states and provides a tidy amount of tax revenue for the state and local governments in the area. The amount of legislation that has grown up in the path of the legalization of video poker in South Carolina is simply amazing, considering that it was at one time considered to be a non-issue. With this focus on doing away with the ubiquitous video poker devices, the government is coming down generally on the side of choosing not to allow the video poker machines to exist in the state. But the owner of a business in South Carolina called Lucky Strike claims that the law is in clear violation of the due process rights that are granted to every citizen by the United States Constitution. While proving this in court is another matter, the fact that the wheels are turning is a positive side note in the overall discussion of allowing video poker machines in the state of South Carolina.
Playing poker is the oldest and most venerable tradition of gaming and gambling in the United States, originating with the game of Texas Hold’em and its popularity among cattle workers and riders on the range as well as soldiers, sailors and travelers of all kinds. The concept of continuing the tradition of playing poker in all manner of establishments as well as in the home dates back quite some time, and it is very unlikely that any random law passed by state or local government will have such a negative affect in the long run as to completely put an end to the practice of playing poker in any state in America.
But pressure brought forth by legal sources can certainly put an end to the proliferation of video poker machines that violate state law and the state has already authorized its law enforcement agents to seize any video poker devices and bring them to the local county magistrate who can then order their destruction if they are found to violate state gambling law.
While this is the most stringent attack on the game of poker and its variations in the United States, it is in keeping with the attitude of most states of disallowing any form of gambling, no matter what type of tax revenue it produces.
